FusionStor stands behind the quality of its products and offers a limited warranty to provide peace of mind to its customers. When used and installed correctly, FusionStor products are warranted to be free from material and workmanship defects for a specified period from the date of purchase as indicated on the invoice. Upon the expiration of the labor and parts warranty period, a 90-day grace period is granted.
This limited warranty is applicable only to the original purchasers of FusionStor' products, including direct customers and distributors of FusionStor. Special warranty terms for other server products will be outlined and specified in the corresponding invoices of individual product purchase orders. FusionStor is committed to ensuring the reliability and performance of its products and strives to deliver exceptional service and support to its valued customers.
This limited warranty does not extend to any failure(s) or defect(s) resulting from misuse, accidents, abnormal or excessively heavy usage, improper packaging or handling, neglect, abuse, alterations, improper installation, unauthorized repairs or modifications, improper testing, or external factors beyond the product's control such as excessive heat or humidity, power failures, power surges, or acts of nature.
Furthermore, this limited warranty will be rendered void if there is evidence of screw holes created by the customer, burnt-out chips, more than four broken wires, signs of unauthorized repair work, or damage inflicted by a party other than FusionStor Expendable components, software provided by FusionStor, experimental or developmental products, compatibility issues with hardware or software introduced after the purchase date, and products or accessories not manufactured by FusionStor are not covered under this limited warranty.
In cases where a product requires return to FusionStor for warranty service, the Customer must first secure an RMA number from FusionStor. The RMA number must be clearly indicated on the exterior of the box containing the returned product. FusionStor will decline acceptance of any shipment lacking an RMA number. Following RMA request processing, FusionStor retains the right to demand the total cost of replacement products or the actual products themselves if damage is later determined to have resulted from the actions of the Customer.
The Customer must provide FusionStor with the following information to obtain an RMA number: invoice date, invoice number, product model name, serial number, and reason for return. The RMA number will be rendered void if the product covered is not received by FusionStor within 30 days of the RMA number's issuance. When returning a product for RMA, the Customer must ship with freight prepaid, include a copy of the original invoice and a detailed note describing the problem inside the box. The Customer must ensure that the RMA number is clearly marked on the outside of the box. All RMAs must be returned in the original packaging of the products.
All product replacements are subject to the quantity available in FusionStor stock. Should FusionStor not have stock to replace the returned products, FusionStor shall have a minimum of 30 days to manufacture and replace the returned products.
SERVICE - Following the expiration of the aforementioned limited warranties, FusionStor may offer additional services for up to 2 years from the date of expiration, subject to additional charges. FusionStor reserves the right to replace defective products with refurbished or functionally equivalent products if it deems, at its sole discretion, that a repair is not feasible. The Customer is responsible for all shipping, service, parts, and other charges associated with out-of-warranty services.
The warranty does not cover products intended for OEM/ODM distribution or refurbished products. Additionally, it does not extend to server semiconductor components and third-party components, including but not limited to CPU socket pins, chipsets, and processors.
Fusionstor's liability under this warranty, whether implied or express, is limited to repair, replacement, or refund of the product. In no event shall Fusionstor be liable for indirect, special, incidental, or consequential damages, regardless of the theory of liability. These damages may include, but are not limited to, lost profits, downtime, goodwill, damage to or replacement of equipment and property, and any costs incurred for recovering, reprogramming, or reproducing any document or data stored in or used with a system containing this product. Please note that some states or jurisdictions may not allow the limitation or exclusion of consequential or incidental damages. Therefore, the above limitations may not apply in certain cases.
